§ 806.04. Trap-shooting.

  • (a)

    No person shall keep, possess, maintain or operate in the municipality any trapshooting or skeet-shooting target range or other place used for the purpose of shooting or firing firearms upon or over the same at a target mark, clay bird, clay pigeon, clay disc or other object without first obtaining a business license from the manager or other duly authorized issuing authority.

    (b)

    The municipality's general licensing regulations contained in chapter 802 apply to this section, with the following additions:

    (1)

    Any person or organization desiring to maintain, use or operate a facility described in subsection (a) hereof shall obtain the standard application form from the manager, complete it and forward it to the Chief of Police. The Chief of Police or his designee shall inspect the premises to ascertain whether or not the following requirements are met:

    a.

    A minimum of 1,000 feet exists from the point of fire to the nearest inhabited dwelling.

    b.

    No live birds or fowl are used as targets.

    c.

    The facility is to be operated only between 9:00 a.m. and 9:00 p.m. Monday through Saturday and between 1:00 p.m. and 6:00 p.m. on Sunday.

    d.

    Only shotgun shells loaded with shot sizes six through 12 are used at the facility. No rifle or pistol shells are permitted. Muzzle loading firearms loaded with shot sizes six through 12 are permitted.

    (2)

    When the Chief of Police or his designee is satisfied that it will not be detrimental to the public safety to keep, maintain, operate or use the target range, he shall indicate his approval by placing his signature on the application.

    (3)

    Upon receipt of the approved application for a license, accompanied by the proper fee, the manager shall deposit the fee with the treasurer and issue to the applicant a proper license.

    (c)

    Every such license shall expire on January 1. The procedure for obtaining a renewal of the license shall be the same as described in subsections (a) and (b) hereof.

    (d)

    The Chief of Police or his designee may enter upon the premises of the trapshooting or skeet-shooting target range at any time to ensure that the facility is not being operated in such a manner as to be detrimental to the public peace and safety, and to ensure that no other conditions exist to merit the suspension or revocation of the license.

    (e)

    Nothing in this section shall be construed to be in conflict with any of the provisions of the building and housing code or any lawful order of the building inspector.
